Jane Smith was billed in error from Chase Auto Finance in which she has a car loan with. Jane Smith's car payment is due on the 12th of the month. Chase Auto Finance claimed that they never recieved her August 2006 payment. Jane Smith mailed out her payment on August 4, 2006 to ensure that there was enough time for Chase to receive it. The mailing address of Chase Auto Finance is located in New Jersey. Eight days is more than enough time for the payment to get there. The payment cleared through her account on August 15th, 2006 but Chase is insisting that they never received it.

the plaintiff who was 11 years old at the time of this occurrence, went to the defendant's place of business, accompanied by her mother, for the purpose of having her left ear pierced in the helix (upper ear) area. The defendant, at that time, operated a small shop where he sold custom jewelry including earrings and necklaces and other trinkets and offeredyour piercing for $10 per ear. The plaintiff, within a fewer days following the piercing, developed an infection. When the infection did not clear, the plaintiff was taken to her pediatrician. After a brief hospital stay of IV antibiotics and a home course of antibiotics, she ultimately had surgery to remove the infected portion of her ear resulting in severe deformity and partial loss of left her upper ear.
