CASE NUMBER 2000-10344
We purchased a Condo in Florida several years ago. Selling documents stated that there was a heated pool. The current Board of Directors insists on turning the pool heater off on May 1 maintaining that 80% of the owners are gone and that Mother Nature will keep the pool temp between 80-89 degrees. We have asked them to simply set the heater at 84-85 degrees to insure proper temperature year-round. They refuse to do so. What options do we have to force compliance with the wording of the Sales Agreement?

Just about five months ago I let the assistant manager use my credit to get a celluar phone, because her credit did not pass. After a while she started treating me ugly and was getting me in trouble with the main boss. In a weeks advance i let her know that my sisterinlaw was going to have a baby so i asked if she could let me off. I got no response. The day that she went into labor I called the assistant and told her that i need the day off and she said no that i better be in. So i had to quit. I had never called in to work and always showed up for work and worked for other people who need off for there kid being sick. So in the end when i quit i decided to see if she had been paying her cell. To my amazement she was two months behind so i disconnected it so that she would not run it up any higher. Also when ever other employers call for a job reference she tells every one i was terminated. She never paid 229.23

As a yahoo buyer I entered a bit for a Tiger Woods Authographed Golf Ball with Certificat of Authenticity on August 2, 2000. I was outbid by another user. However, about a day after the closing of the auction I received an email from the seller stating that he did have two additonal Golf Balls of that kind and was willing to sell me one of them for my last bid price of $45 plus $4.50 S/H. I mailed a check to the seller have not heard from him since. I did not receive my purchased item nor any repsonces to numerous emails that I have sent him. He cashed the check I sent him on August 16, 2000, which was verified by my Bank. I reviewed his seller feedback ratings and found that he has done this to several others as well as the buyer that outbid me originally in this auction.

I was riding my motorcycle with my girlfriend on a clear, dry night in June about 9:00pm. We were riding with another motorcycle carrying two friends. We were riding through a small town. There was a new shopping center that had built a retention pond for the water that ran off the parking lot when it rained. The owner of the shopping center rented a 6" pump to drain the pond. The owner layed the discharge nozzle on the street so as to pump the water across the road to the ditch on the other side of the street. There were no warning signs, cones, or flashing lights, and there were no street lights since this was a small town. We hit the wall of water gushing across the street and went down. Something snapped in my upperleg and I have had one operation, plus a year of therapy. My girl friend ruptuted the ligiments in her wrist, and has had two surgerys, plus a year of therapy. She still can't work.

On June 1st 2000 I entered a contract to provide, LABOR ONLY, to plaster a storefront for a general contractor/owner. General contractor to provide scaffolding and materials. I ended up providing as much scaffold as I could gather to do job. On june 7th, while working from scaffold, I set up, I fell and broke both feet. Rt foot shattered and needed 11 screws and plate in heel. I may never walk same again. Will definately be unable to work from and climb scaffold again. This injury has impaired my ability to produce the income I am accustomed to. Along with pain and suffering through recovery. I will not be able to run again. I believe the general should be held liable, as he was to provide scaffold, and save work enviroment. I was paid for job for my labor. There was no written contract. Verbal only

I LET THE DEFENDENT STORE HIS MOTORCYLCE AT MY HOUSE IN MY GARAGE UNTIL HE COULD SELL IT. A COUPLE OF DAYS LATER I LOOKED UNDER THE BIKE AND FOUND THAT IT HAD BEEN LEAKING OIL. AFTER BRYAN REMOVED THE BIKE I TRIED TO CLEAN THE OIL UP BUT IT HAD STAINED THE FLOOR. I HAD TO HAVE A PROFESSIONAL COME IN AND REMOVE THE STAIN. THE TOTAL COST WAS $250 FOR CHEMICALS AND TIME. AFTER CONFRONTING BRYAN ABOUT THIS HE SIMPLY TOLD ME THAT THATS WHAT GARAGES WERE FOR AND GET OVER IT. ALL I WANT IS THE COST I HAD TO PAY TO HAVE IT CLEANED.

I cancelled my internet dialup service with the Defendant on June 18, 2000. On July 17, 2000, I was still billed the monthly fee of $16.91 on my credit card. After many phone calls and emails, the company still refuses to refund my payment even though they confirm that the account had been disabled at the time of the July billing.
