My landlord is suing me for withholding rent due to some fixtures that needs to be repaired in my apartment. I have spoken to him on numerous occasions, concerning a leak in the ceiling and he refuses or basically just chooses to ignore my claim. This leak has damaged some of my personal property and I think it’s unfair that I should have to pay for these items. I think that it’s his responsibility to upkeep the apartment. He does not have a problem when I pay him the rent every month.

On Tuesday May 12,1998 at approximately 7:20 p.m. I was heading south bound on Elwood Road located in East Northport, New York in Suffolk County. I was at a complete and full stop in the left hand turning lane waiting for the traffic light to change signals so that I could proceed east bound on Jericho Turnpike. While at a complete and full stop, my vehicle was rear-ended and I was knocked unconcious and was taken by ambulance to St. Catherine of Siena Hospital In Smithtown, New York where I was treated for a closed head injury and neck and back injuries.

I was brought in to the Emergency Room for Diabetic Shock. I was treated for complications of Diabetes but the IV was not properly inserted into my vein and the fluids infiltrated into the surrounding tissue. To alleviate the fluid build up a hot compress was applied directly to my skin without a covering and I received first and second degree burns on the lower half of my arm.

On Friday evening, 7/2/2004, I went to the emergency department of the local hospital with pain in my right lower quadrant. I was seen by a resident but was not treated until Monday, 7/7/2004 when the attending physician came on duty, examined me and immediately sent me to surgery for removal of my appendix. Accepted standards of care were not followed and as a result I suffered needless pain and nearly died. I am seeking money damages.
