My case involves a lease that was breahced due to non-operable services. The lease was breached because during the duration of the lease, both the outdoor inground pool and indoor jacuzzi broke down shortley after the start date of the lease, and were not serviced and operable again untill near the end of the lease. The lease began May 28, 2003 and ended September 7, 2003.

I am a Landlord in Suffolk County, Long Island and have an apartment in which I am renting to my Tenant. Both I (Landlord) and Tenant has signed a lease to rent the apartment. Tenant has lived in the apartment in my house for the past year and has paid his rent on time up until now. Tenant stopped paying rent and refused to pay for over 2 months saying he was laid off from his job. Landlord immediately got a process server to serve tenant with a "Notice to Vacate" (copy enclosed). Tenant was to appear in court and did show up but asked for an adjournment. Judge granted adjournment for 4 weeks. Second court date judge ordered tenant to get out of apartment. Tenant refused to vacate and continued to live in apartment (not paying rent) for 3 more months. At which time he was removed by the Sherriff's Dept.

I signed a lease for the apartment I am living in. Within the lease, my landlord agreed to fix any major fixtures that need repair within 72 hours of notification. My kitchen sink began to have draining problems. I notified my landlord about this & at first he said it wasn't his problem. Then finally after many unsuccessful attempts to unclog the sink myself, he agreed to fix it. However, it took two weeks for it to be fixed since I first notified my landlord. The problem was fixed temporarily but now I have another kitchen sink clog & it has been a over a week that I have been waiting for my landlord to call a plumber again to fix the sink. The sink has been completely unusable and this is not a suitable living situation.

Recently, I Purchased a Central Air Conditioner system from Snow Central Inc. & had it professionally installed by their licensed contractor. As the contractor was installing the Central Air Unit he must have placed the Greasey Unit orBox on my Nice New Carpets which were Installed By Rug Installers "R" US Inc. The Grease won't come out, even after having it professionally cleaned by Mr. Rug Cleaners Inc. I would like to have the rug completely replaced. Snow Central Inc. wants to have the carpet fixed professionaly by having their Rug Professional cut out a 4 foot square section of the rug and have it patched back in.
